Terms of Use

These terms are the agreement between you and ZSAMM (“we”, “us”), operated from Germany. They cover the ZSAMM mobile app for iOS and Android and the website at zsamm.cc, including the public activity and club pages. By creating an account or using the app or the site, you agree to them.

How we handle your data is a separate document: the privacy policy.

You need to be at least 16. One account per person. Sign in with an email magic link, Google or Apple — keep access to that mailbox or account secure, because whoever has it has your ZSAMM account.

Use a name and photo that actually represent you. Other people decide whether to meet you in a park at 07:00 based on what your profile says, so impersonating someone else, or posing as a club or business you don’t represent, is a serious breach of these terms rather than a small one.

ZSAMM is a noticeboard. Users post rides, runs and other activities; other users find them and say they’re coming. That is the whole service.

We are not the organiser.Every activity on ZSAMM is created and run by the user whose name is on it, not by us. We don’t plan them, lead them, supervise them, check that they go ahead, or take responsibility for how they turn out.

We do not vet people. We run no background checks, identity checks, or qualification checks on organisers or participants. A profile on ZSAMM is a claim someone made about themselves, not something we have verified. The only exception is a badge we explicitly grant — those are issued by us and cannot be self-assigned.

We are also not a race directory, a coaching service, a guiding service, or a ticket seller. No money changes hands through ZSAMM.

This is the part that matters most. ZSAMM exists so strangers can meet up and exercise together, in the real world. Both halves of that carry risk, and you take part at your own risk.

Sport carries risk of injury or worse.Cycling and running in traffic and on trails can end badly. You are responsible for judging whether an activity suits your fitness and ability, for your own equipment and its condition, for wearing what you should wear, for obeying traffic law, and for your own insurance and health cover. A difficulty label or pace note on an activity is one user’s rough estimate — not a standard, and not a promise.

Other participants are strangers.Meet in public places, tell someone where you’re going and when you expect to be back, and leave if a situation feels wrong. Trust your judgement over the app.

You are responsible for your own conduct, and each user is responsible for theirs. To the extent the law allows, we are not liable for what other users do or fail to do, on ZSAMM or in person — see section 12 for exactly how liability works.

Describe it honestly: the sport, the difficulty, the pace, the distance, the date and time, and where to meet. People will make decisions about their day, their body and their safety based on what you wrote.

Set a meeting point that is public and safe to gather at — never your home address, and never a place you have no right to send people to. Make sure the activity itself is legal where you are holding it, and get any permission a route or venue needs.

If plans change, edit the activity or cancel it in the app so the people who joined find out. Turning up matters — and so does saying you won’t.

Don’t use ZSAMM to sell places, charge fees, or run a commercial event without our written agreement. Paid organiser features may exist in the future; until then, activities are free to join.

Don’t use ZSAMM to:

harass, threaten, bully or stalk anyone; post hateful, violent, sexual or discriminatory content; impersonate someone else; post spam, advertising or repeated junk activities; post anything illegal, or organise anything illegal; upload images you have no right to use, or that show people who haven’t agreed to appear.

And don’t attack the service itself:

no scraping, crawling or bulk collection of profiles, activities or meeting points; no automated access outside the app; no probing, bypassing or testing our security or access rules without our written permission; no reverse engineering; no using another user’s account; no using ZSAMM data to build a mailing list, a dataset, or a competing directory.

Location data about where groups of people will be, and when, is the most sensitive thing here. Treat it as belonging to those people.

Our Code of Conduct sets out what all of this means in practice — at the meeting point, on the road, and in how you treat the people you meet. It forms part of these terms.

Your profile, activities, descriptions, photos and routes stay yours. You give us the permission we need to run the service with them: to store, display and distribute them inside ZSAMM, and — for an activity — on its public share page at zsamm.cc/a/… That permission is free, worldwide, and lasts as long as the content is on ZSAMM.

You confirm you have the right to post what you post. For photos, that means you took them or are licensed to use them, and the people in them are fine with it. For routes, a file or link you attach stays subject to whatever terms the route provider imposes.

Delete your content or your account and we stop displaying it — allowing for a short window for caches and backups to clear.

You can report an activity or a user, and you can block a user — a block works in both directions, so neither of you appears to the other. Use it; it’s the fastest tool you have.

Telling us about illegal content. Anyone can, with or without an account, by emailing hello@zsamm.cc. So that we can act on it, tell us: why you believe the content is illegal; where it is, precisely enough for us to find it — a link, or the activity or club and the name it appears under; your name and email address; and that what you have told us is accurate and given in good faith. We confirm we have it, tell you what we decided, and explain how you can challenge that decision.

How the decision gets made. A person reviews reports and notices. We use no automated content moderation — nothing on ZSAMM is removed, hidden or restricted by a machine deciding on its own.

If we act against you. We can remove content, and restrict, suspend or terminate accounts, where these terms are broken or where someone is making the platform unsafe. When we do, we tell you what we did and what it applies to, whether it was because the content is illegal or because it breaks these terms, what we relied on in deciding, and how to challenge it.

Challenging what we did. Reply to hello@zsamm.cc and say why you think we got it wrong. We look again, and we can reverse it. None of this touches your right to go to a court instead, at any point.

For anything urgent — a threat, someone in danger — contact your local emergency services first, then us. Where we learn something that suggests a threat to someone’s life or safety, we may pass it to law enforcement.

ZSAMM is early software. Features get added, changed and removed, and we don’t promise any particular feature, platform or level of availability. We may introduce paid plans for organisers later; if we do, anything you already have stays free unless we tell you otherwise in advance.

We can suspend the service for maintenance, or discontinue it. If we shut it down, we’ll give reasonable notice so you can get your data out.

You can leave at any time: delete your account in Settings, or start from zsamm.cc/delete-account. Deletion is permanent and removes your profile, your activities, your joins and your uploads (see the privacy policy).

We may terminate or suspend your account for a serious or repeated breach of these terms. Sections that by their nature should outlive the account — content licence for anything still lawfully published, liability, and governing law — continue to apply.

ZSAMM relies on other services — maps and place search, sign-in providers, route providers, push delivery, and the app stores. Their own terms apply to your use of them, and we aren’t responsible for what they do.

If you installed ZSAMM from the App Store: this agreement is between you and us, not with Apple. Apple has no obligation to provide support or maintenance for the app, and is not responsible for any claim you may have about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Equivalent terms apply to Google Play.

ZSAMM is provided as is. We don’t warrant that it will be uninterrupted or error-free, that activities listed on it will actually happen, or that other users are who they say they are.

We are fully liable — without limit — for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever mandatory law imposes liability regardless of fault, including under the German Product Liability Act.

For slight negligence, we are liable only where we breach an obligation that is essential to this agreement and that you may reasonably rely on us to meet, and then only for foreseeable damage typical of this kind of agreement. All other liability for slight negligence is excluded.

These limits do not restrict your mandatory rights as a consumer.

The website is informational: it describes the app, links to the beta builds and hosts the public activity and club pages. It does not create an account, reserve anything, or guarantee that any particular feature, platform or launch date will be available. What it does with data is in the privacy policy.

The ZSAMM name, logo, app and the content of this site belong to us. You may not copy or reuse them for your own products or branding without permission. Descriptions of unreleased features are previews of work in progress and may change.

We may update these terms; the date above reflects the latest version. We’ll give you reasonable notice of material changes in the app or by email. If you don’t accept them, stop using ZSAMM and delete your account.

These terms are governed by the laws of Germany. If you are a consumer, you also keep the protection of any mandatory rules of the country you live in. We are not obliged, and are not willing, to take part in dispute-resolution proceedings before a consumer arbitration board.
